Ogun Clarifies Status of Court Case Against Datkems, Denies Dismissal by Court of Appeal

The Ogun State Government has refuted claims that the Court of Appeal dismissed its appeal in a legal case against Datkems, a company linked to Senator Gbenga Daniel, who represents Ogun Central in the National Assembly. In a statement released on Wednesday by Hon. Kayode Akinmade, Special Adviser on Media and Strategy to the Governor, the government clarified that it voluntarily withdrew one of its four appeals due to a technical error, while three other appeals remain pending.

The government accused Datkems of spreading falsehoods by misrepresenting the withdrawal as a judicial victory. According to the statement, the Court of Appeal has yet to rule on the substantive issues of the case, and Datkems has not filed any substantive response to the allegations against it.

“The Ogun State Government still has three pending appeals against Datkems before the Ibadan Division of the Court of Appeal,” the statement read. “The withdrawal of the fourth appeal was purely procedural, as the government noticed an error in the title of the Notice of Appeal. The court’s decision to end the appeal and delete its number does not prevent the government from reinitiating the appeal.”

The statement further emphasized that the three ongoing appeals are strong and have been adjourned to May 19, 2025, for hearing. It also highlighted that Datkems has yet to submit any arguments in response to the appeals.

The Ogun State Government also raised concerns about Datkems’ credibility, recalling that the company had filed its case on September 7, 2023, under the name “Datkems Enterprises Limited.” However, investigations revealed that no such company was ever registered, rendering the case incompetent. “Datkems had no answer to that point at the trial court and has had no answer to this day,” the statement noted.

The government accused Datkems of attempting to distract from the substantive issues by portraying minor administrative decisions as significant legal victories. “Time will tell, and the Ogun State Government will prevail,” the statement concluded.

The case continues to draw public attention as both parties prepare for the next hearing in 2025.
